Please read these terms carefully before placing an order, creating an account, purchasing products or using any Islamic Foods service.

Welcome to Islamic Foods. These Terms & Conditions (“Terms”) govern your use of our website, online ordering platform, mobile applications (if applicable), physical store services, home delivery services, and other products and services provided by Islamic Foods.

Please read these Terms carefully before placing an order, creating an account, purchasing products, or using any service provided by Islamic Foods. By accessing our website, placing an order, purchasing products, or using our services, you acknowledge that you have read, understood, and agreed to comply with these Terms.

These Terms should be read together with our Privacy Policy, Return & Refund Policy, Delivery Policy, and other applicable policies published by Islamic Foods.

Section 1: Introduction

Islamic Foods is a community-based supermarket business established with the objective of providing customers with safe, fresh, quality and reasonably priced food and household products.

Our business operates with a Shareholder Community Model, under which eligible individuals may participate in the business as shareholders according to the company's applicable rules and policies.

Islamic Foods aims to provide grocery products, food items, fresh vegetables, fish, meat, household products, home-care products and other daily necessities through its physical and online sales channels.

Our services may include:

Physical retail shopping

Online ordering

Home delivery

Grocery and food product sales

Shareholder-related services

Promotional offers and customer services

Other services introduced by Islamic Foods from time to time

Section 2: Definitions

2.1. “Company”, “Islamic Foods”, “we”, “us” and “our”

These terms refer to Islamic Foods and its authorized representatives, employees, management and applicable business operations.

2.2. “Customer”, “you”, “your” and “yours”

These terms refer to any person who accesses our website, purchases our products, places an order, uses our services or otherwise interacts with Islamic Foods.

2.3. “Website”

“Website” means the official Islamic Foods website and any other official online platform operated by or on behalf of Islamic Foods.

2.4. “Goods” or “Products”

“Goods” or “Products” means any grocery, food, beverage, fresh produce, fish, meat, household, home-care or other products offered for sale by Islamic Foods.

2.5. “Services”

“Services” means any service provided by Islamic Foods, including online ordering, home delivery, customer support and other services offered from time to time.

2.6. “Order”

“Order” means a request submitted by a customer to purchase one or more products from Islamic Foods.

2.7. “Shareholder”

“Shareholder” means a person who has officially acquired shares or participation rights in Islamic Foods in accordance with the company's approved rules, documentation and applicable law.

2.8. “Shareholder Community Model”

The “Shareholder Community Model” means the business model under which shareholders may participate in the business as investors and customers and contribute to the development and sales activities of the business in accordance with the company's policies.

2.9. “Delivery”

“Delivery” means the transportation and delivery of purchased products from Islamic Foods to the delivery address provided by the customer.

Section 3: General Terms of Use

3.1. By using our website, placing an order or purchasing our products, you agree to comply with these Terms and all applicable Islamic Foods policies.

3.2. You agree to provide accurate, complete and up-to-date information when creating an account, placing an order, making payment or communicating with us.

3.3. Islamic Foods reserves the right to refuse, suspend or cancel an order where there is a reasonable reason to do so, including product unavailability, pricing errors, payment problems, delivery limitations, suspected fraud or violation of these Terms.

3.4. Products purchased through Islamic Foods are intended primarily for personal and household consumption unless Islamic Foods expressly agrees otherwise.

3.5. Customers must not use Islamic Foods services for unlawful activities, fraudulent transactions, unauthorized resale, abuse of promotional offers or any activity that may harm the company, its customers or other stakeholders.

Section 4: Customer Accounts and Security

4.1. Customers may be required to create an account to access certain online services.

4.2. Customers are responsible for maintaining the confidentiality of their account information, passwords, OTPs and other security credentials.

4.3. Customers must not share their account password, OTP or other confidential authentication information with unauthorized persons.

4.4. If you believe that your account has been accessed without authorization, you should notify Islamic Foods immediately.

4.5. Islamic Foods will take reasonable measures to protect customer account information; however, we cannot be responsible for unauthorized access resulting from the customer's own negligence, including sharing passwords or OTPs.

Section 5: Ordering

5.1. Customers may place orders through the official Islamic Foods website, mobile application (if available), telephone, physical store or other officially authorized channels.

5.2. When placing an order, customers must provide accurate information including their name, telephone number, delivery address and other information reasonably required to process the order.

5.3. An order request does not automatically guarantee that the order will be accepted or fulfilled.

Applicable pricing

Product weight or quantity

Delivery capacity

Payment confirmation

Delivery area

Acceptance by Islamic Foods

5.5. After receiving an online order, Islamic Foods may provide an order confirmation through SMS, email, telephone, website notification or other available communication methods.

5.6. An order confirmation confirms receipt of the order request but does not necessarily constitute final acceptance if product availability, pricing, quantity or delivery capacity remains subject to verification.

5.7. For products sold by weight, including vegetables, fish, meat and similar products, the final price may vary according to the actual weight supplied.

5.8. If an ordered product becomes unavailable, Islamic Foods may inform the customer and, where appropriate, offer a replacement product, partial fulfillment, cancellation or refund.

Section 6: Product Availability and Product Information

6.1. Islamic Foods makes reasonable efforts to ensure that product information, photographs, descriptions, prices and availability displayed on its platforms are accurate.

6.2. However, minor differences may occur between product photographs and the actual product, particularly in relation to fresh produce, packaging, weight, colour, size and appearance.

6.3. Fresh products such as vegetables, fish and meat may naturally vary in size, weight, appearance and availability.

6.4. Islamic Foods reserves the right to modify, replace, suspend or discontinue any product without prior notice, subject to applicable law and any confirmed customer order.

6.5. Where a product has specific storage, preparation, age or usage requirements, customers should carefully review the available product information before purchase.

Section 7: Prices

7.1. All prices displayed by Islamic Foods shall generally be stated in Bangladeshi Taka (BDT) unless otherwise specified.

7.2. Islamic Foods makes reasonable efforts to maintain accurate prices; however, prices may change due to supplier pricing, market conditions, promotions, stock availability, taxes, operational costs or technical or human error.

7.3. The price applicable to an order will normally be the price confirmed at the time of order acceptance, subject to applicable weight-based adjustments and other clearly disclosed charges.

7.4. If a significant pricing error is identified before dispatch, Islamic Foods may contact the customer to confirm whether the customer wishes to proceed at the correct price.

7.5. If the customer does not agree to the corrected price, the affected item or order may be cancelled and any eligible payment may be refunded according to the applicable Refund Policy.

7.6. Prices available through the online platform may differ from prices available at the physical store due to promotions, operational arrangements or other business reasons.

Section 8: Payment

8.1. Islamic Foods may provide one or more payment methods, including:

Cash on delivery

Bank payment

Debit or credit card

Mobile Financial Services (MFS), where available

Other payment methods officially introduced by Islamic Foods

8.2. Customers must ensure that sufficient funds are available when using electronic or digital payment methods.

8.3. Islamic Foods may require payment before delivery for certain orders, products, customers or circumstances.

8.4. An order may be cancelled if payment is not completed within the required period.

8.5. Where payment is processed through a third-party payment provider, the customer may also be subject to that provider's applicable terms and conditions.

8.6. Islamic Foods will not ask customers to disclose passwords, PINs or confidential banking credentials to our employees.

Section 9: Delivery

9.1. Islamic Foods may provide home delivery within its designated delivery areas.

9.2. Delivery availability depends on location, distance, operational capacity, weather, traffic, product availability and other circumstances.

9.3. The estimated delivery time provided at the time of ordering is an estimate and may change due to circumstances beyond our reasonable control.

9.4. Customers must provide an accurate delivery address and a reachable telephone number.

9.5. Customers should ensure that reasonable arrangements are available to receive the order safely.

9.6. If the customer is unavailable to receive the order or provides an incorrect address or insufficient delivery instructions, Islamic Foods may attempt to contact the customer and may reschedule or cancel the delivery.

9.7. Additional delivery charges may apply where applicable. The applicable delivery charge or free-delivery condition will be communicated through our website, order confirmation or other official communication.

9.8. Islamic Foods may provide free home delivery subject to the minimum purchase amount and other conditions announced by the company from time to time.

9.9. Delivery to areas outside our designated service area may not be available.

9.10. In exceptional circumstances, including severe weather, natural disasters, transportation disruptions, public emergencies, strikes or other events beyond our reasonable control, delivery may be delayed or cancelled.

Section 10: Cancellation of Orders

10.1. A customer may request cancellation of an order by contacting Islamic Foods as soon as possible.

10.2. Cancellation requests made before the order has been processed or dispatched will generally have a greater possibility of being accepted.

10.3. Once an order has been prepared, packed or dispatched, cancellation may be subject to additional conditions.

10.4. Islamic Foods may cancel an order where:

The requested product is unavailable;

There is a significant pricing or product information error;

The delivery address is outside the service area;

Payment cannot be verified;

There is suspected fraud or misuse;

Delivery cannot reasonably be completed; or

Other reasonable circumstances prevent fulfillment.

10.5. If Islamic Foods cancels an order for which payment has already been received, the eligible amount will be refunded according to the applicable Refund Policy and payment method.

Section 11: Return, Replacement and Refund

11.1. Islamic Foods aims to provide customers with fresh, safe and quality products.

11.2. Customers should inspect delivered products as soon as reasonably possible and report any wrong, damaged, defective, expired or otherwise eligible product to Islamic Foods within the period specified in our Return & Refund Policy.

11.3. Where a product is delivered incorrectly, is damaged during delivery, or otherwise qualifies under the Return & Refund Policy, Islamic Foods may provide:

Replacement;

Refund;

Store credit; or

Another appropriate solution.

11.4. Certain products may not be eligible for return because of their nature, including certain perishable, fresh or temperature-sensitive products, except where the product is defective, damaged, incorrect or otherwise covered by applicable law or our Return Policy.

11.5. Customers may be required to provide photographs, order information, receipts or other reasonable evidence to process a return or refund claim.

11.6. Refunds will normally be processed through the original payment method where reasonably possible.

11.7. The detailed conditions, time limits and procedures for returns and refunds will be stated in the Islamic Foods Return & Refund Policy.

Section 12: Shareholder Community Model

12.1. Islamic Foods operates a community-based business model in which eligible individuals may participate as shareholders according to the company's approved rules and applicable legal requirements.

12.2. A person wishing to become a shareholder must complete the company's required application and verification process.

12.3. The minimum shareholder investment currently specified by Islamic Foods is BDT 10,000 (Ten Thousand Taka), subject to the company's approved policies and applicable law.

12.4. Shareholder investment must be deposited through the officially designated payment or bank account of Islamic Foods.

12.5. For each valid payment, Islamic Foods will provide appropriate official documentation or money receipt in accordance with its accounting procedures.

12.6. A shareholder must comply with the company's shareholder rules, policies, documentation requirements and other applicable conditions.

12.7. To support the community-based sales model, each shareholder is required, under the company's current policy, to purchase products worth at least BDT 10,000 per month.

12.8. The monthly purchase requirement is a business participation condition and should not be interpreted as a guarantee of profit, investment return or appreciation in share value.

12.9. Any profit distribution to shareholders will be subject to the company's financial performance, approved accounts, applicable policies, shareholder rights and applicable law.

12.10. Statements concerning annual profit sharing represent an opportunity or entitlement only where applicable under the company's approved shareholder arrangements and applicable law. Islamic Foods does not guarantee a fixed annual profit unless expressly provided in a legally valid agreement.

12.11. Shareholder benefits, priority services, delivery benefits, special offers or other privileges may be subject to specific conditions announced by Islamic Foods.

12.12. Shareholder status does not automatically guarantee employment, a fixed income, guaranteed profit, guaranteed product availability or any other benefit unless expressly provided under a separate written agreement or company policy.

Section 13: Shareholder and Customer Responsibilities

Customers and shareholders agree to:

Provide accurate information;

Follow Islamic Foods policies;

Make payments on time;

Maintain account security;

Treat employees, delivery personnel and other customers respectfully;

Not engage in fraudulent activity;

Not misuse promotional offers;

Not provide false information;

Not attempt to manipulate the ordering system;

Not interfere with the website or company's digital systems;

Cooperate with reasonable verification procedures.

Section 14: Complaints and Customer Support

14.1. Islamic Foods takes customer complaints seriously and aims to address genuine complaints fairly and efficiently.

14.2. Customers should provide their order number, name, contact information and relevant details when submitting a complaint.

14.3. Complaints may be submitted through the official customer service channels published by Islamic Foods.

14.4. Where necessary, customers may be requested to provide photographs, receipts or other evidence relating to the complaint.

14.5. Islamic Foods will review complaints based on the available information and applicable company policies.

14.6. The final decision regarding a complaint, return, replacement or refund will be made in accordance with the applicable policy and applicable law.

15.1. Islamic Foods respects the privacy of its customers and shareholders.

15.2. We may collect information necessary to provide our services, including name, telephone number, email address, delivery address, order information and payment-related information.

15.3. Personal information will be handled in accordance with our Privacy Policy and applicable law.

15.4. Customers may contact Islamic Foods through the official channels to ask questions about the personal information held by the company, subject to applicable legal requirements.

Section 16: Communication and Marketing

16.1. By using our services, customers may receive necessary communications relating to their orders, accounts, payments, deliveries and customer service.

16.2. Where legally permitted and subject to applicable consent requirements, Islamic Foods may also send information about promotions, products, services and special offers.

16.3. Customers may be provided with an option to opt out of promotional communications where applicable.

16.4. Important service-related communications may still be sent where necessary to complete an order or provide a requested service.

17.1. Islamic Foods will make reasonable efforts to keep its website and online services available and functional.

17.2. However, temporary interruptions may occur due to maintenance, technical problems, internet connectivity, system upgrades, security incidents or other circumstances.

17.3. Customers must not:

Hack or attempt to hack our website;

Introduce viruses or malicious software;

Use automated systems to abuse the website;

Scrape or copy data without authorization;

Attempt unauthorized access to accounts or systems;

Interfere with website functionality;

Collect other users' personal information without authorization.

17.4. Islamic Foods reserves the right to suspend or restrict access to any account or digital service where there is reasonable evidence of misuse, fraud, security risk or violation of these Terms.

Section 18: Intellectual Property

18.1. Unless otherwise stated, the content of Islamic Foods' website and official digital platforms, including logos, trademarks, text, photographs, graphics, designs, software, product presentations and other materials, belongs to or is lawfully used by Islamic Foods.

18.2. No person may reproduce, copy, modify, distribute, publish or commercially use our protected content without prior written authorization, except where permitted by law.

18.3. The name Islamic Foods, its logo and associated branding may not be used in a manner that suggests unauthorized association with or endorsement by Islamic Foods.

Section 19: Third-Party Links and Services

19.1. Our website or digital platforms may contain links to third-party websites, payment providers, service providers or other external platforms.

19.2. Islamic Foods does not necessarily control or endorse the content, availability, security or services of third-party websites.

19.3. Customers who access third-party websites do so at their own discretion and may be subject to the third party's terms and privacy policies.

Section 20: Limitation of Liability

20.1. Islamic Foods will take reasonable care to provide accurate information, quality products and reliable services.

20.2. However, we do not guarantee that our website or digital services will always be uninterrupted, completely error-free or free from technical problems.

20.3. To the maximum extent permitted by applicable law, Islamic Foods shall not be responsible for indirect or consequential losses arising from the use of our website or services.

20.4. Nothing in these Terms is intended to exclude or limit any liability that cannot legally be excluded or limited under applicable law.

20.5. Where Islamic Foods is legally responsible for a loss relating to a particular order, the extent of liability may be limited to the amount paid for the affected product or service, subject to applicable law and the circumstances of the claim.

20.6. Islamic Foods will not be responsible for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, severe weather, fire, flood, transportation disruption, strikes, government restrictions, public emergencies, shortages, technical failures or other force majeure events.

Section 21: Fraud, Misuse and Promotional Offers

21.1. Islamic Foods may investigate transactions where there is a reasonable suspicion of fraud, abuse, manipulation or unauthorized activity.

21.2. Where fraud or serious misuse is identified, Islamic Foods may cancel affected orders, restrict accounts, withdraw promotional benefits or take other lawful action.

21.3. Promotional offers, discounts, coupons and special benefits are subject to their specific terms and conditions.

21.4. Islamic Foods reserves the right to withdraw or modify promotional offers where reasonably necessary, subject to applicable law.

Section 22: Changes to These Terms

22.1. Islamic Foods may update or amend these Terms from time to time to reflect changes in our business, services, technology, policies or legal requirements.

22.2. Updated Terms may be published on our website or communicated through other appropriate channels.

Section 23: General Provisions

23.1. These Terms, together with our Privacy Policy, Return & Refund Policy, Delivery Policy and other applicable policies, constitute the general terms governing the relationship between Islamic Foods and its customers in relation to the relevant services.

23.2. If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

23.3. Failure by Islamic Foods to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision in the future.

23.4. Islamic Foods may use authorized employees, delivery partners, service providers or contractors to provide certain services.

23.5. Customers may not transfer their rights or obligations under these Terms to another person without the prior written consent of Islamic Foods, where such consent is required.

Section 24: Governing Law and Dispute Resolution

24.1. These Terms shall be interpreted and applied in accordance with the applicable laws of Bangladesh.

24.2. Islamic Foods and its customers should first attempt to resolve any dispute through good-faith communication and the company's complaint-handling process.

24.3. Where a dispute cannot be resolved through communication or internal complaint procedures, the parties may pursue mediation, arbitration or other legally available dispute-resolution procedures where appropriate.

24.4. Nothing in these Terms prevents a customer from exercising any mandatory rights or remedies available under applicable Bangladesh law.

By accessing the Islamic Foods website, creating an account, placing an order, purchasing products, requesting delivery, or using our services, you acknowledge that:

You have read these Terms & Conditions;

You understand the applicable terms;

You agree to comply with these Terms;

You have provided accurate information;

You agree to comply with applicable payment, delivery and return conditions; and

Where you participate as a shareholder, you agree to comply with the applicable shareholder rules and policies.

If you do not agree with these Terms, please do not use the relevant Islamic Foods services.
